This article analyses 1,073 e-mails that were hacked from the Climatic Research Unit at the University of East Anglia in November 2009. The incident was popularly dubbed 'Climategate', indicating that the e-mails reveal a scientific scandal. Here we analyse them differently. Rather than objecting to the exchanges based on some idea about proper scientific conduct, we see them as a rare glimpse into a situation where scientists collectively prepare for participation in heated controversy, with much focus on methodology. This allows (...) us to study how scientists communicate informally about framing propositions of facts in the best possible way. Through the eyes of science and technology studies, the e-mails provide an opportunity to study communication as part of science in the making across disciplines and laboratories. Analysed as 'written conversation' the e-mails provide information about processes of consensus formation through 'agonistic evaluations' of other scientists' work and persuasion of others to support one's own work. Also, the e-mails contain judgements about other groups and individual scientists. Consensus-forming appeared as a precarious activity. Controversies could be quite resilient in the course of this decade-long exchange, probably reflecting the complexity of the methodological challenges involved. (shrink)

Sentences that ascribe action are logically related, but it is not always obvious why. According to event semantics, implications and non-implications result from referential relations between unpronounced constituents. Taking as starting point examples including free relative clauses, this paper advances the alternative view that examples as such present logical relations as forms of predicative dependence indicated with pronounced constituents. To this end, I argue that Verbal Phrases and verbal traces follow the pattern of Verbal Phrase Anaphora and, more controversially, that (...) they can be semantically interpreted in terms of higher-order quantification that represent actions as properties, but neither as events nor event-kinds. The novelty is not so in his original ideas as in the fact that these are useful to keep on completing the doctrine of a "descriptive" and "naturalist" metaphy-sick against "revisionism" such as the scepticism in its different modalities.

[What It’s Like, or What It’s About? The Place of Consciousness in the Material World] Summary: The book is both a survey of the contemporary debate and a defense of a distinctive position. Most philosophers nowadays assume that the focus of the philosophy of consciousness, its shared explanandum, is a certain property of experience variously called “phenomenal character,” “qualitative character,” “qualia” or “phenomenology,” understood in terms of what it is like to undergo the experience in question. Consciousness as defined in (...) terms of its phenomenal aspect is often called “phenomenal consciousness.” The major issue that occupies most thinkers is whether this phenomenal character happens to be a physical property, or whether it is rather sui generis. Those who believe the former are materialists; those who conclude the latter are dualists. As the currently dominant metaphysic is materialism – also sometimes called physicalism – the challenge appears to be to slot phenomenal properties among the physical properties that ultimately make up the world. David Chalmers argued powerfully that we can go very far in situating many mental properties in the physical world – namely, the properties that can be understood in functional terms – but that phenomenal properties resist such a treatment. Chalmers calls this “the hard problem” of consciousness. But there are also some quite powerful positive arguments for dualism. The two most influential ones are the modal argument, also offered by Chalmers, and the knowledge argument invented by Frank Jackson. Chalmers invites us to conceive of creatures that are exactly like human beings – physically, functionally, behaviorally – only bereft of phenomenal consciousness. If such creatures are conceivable, says Chalmers, they are metaphysically possible. And if they are metaphysically possible, materialism is false. Jackson, for his part, suggests we imagine Mary who has spent her entire life inside a black-and-white room and has seen the world through a black-and-white TV screen. But she also happens to know everything there is to know about the physics of color. And yet, Jackson suggests that once Mary is finally released from her room and sees a lawn outside, she learns something new: that this is what it is like to experience green color. The current work on consciousness is by and large characterized by attempts to answer these two dualistic arguments. I try to make sense of the positions within the domain of philosophy of consciousness by means of two major distinctions that mutually intersect. First, there is a distinction between dualism and materialism. An apparent third alternative currently on offer, the so-called Russellian monism, is unstable, collapsing into either dualism (panpsychism) or materialism (Russellian physicalism). Materialism comes in two main flavors: either the a posteriori physicalism, which detects an epistemic gap between phenomenal and physical truths, hence denying that the former could be derived from the latter; or the a priori physicalism, which does not acknowledge any such obstacle. The second major distinction is between phenomenism and representationalism. It’s true that Ned Block, who introduced this contrast, meant to distinguish between two kinds of materialism. But I believe that the distinction actually intersects the one between materialism and dualism. We thus arrive at a table with six slots, representing six main positions in the philosophy of consciousness: (1) dualist phenomenism (Chalmers, the early Jackson, and Tyler Burge); (2) dualist representationalism (René Descartes); (3) aposteriori materialist phenomenism (Block); (4) a posteriori materialist representationalism (Michael Tye, Fred Dretske, David Rosenthal); (5) a priori materialist phenomenism (David Lewis); and (6) a priori materialist representationalism (Daniel Dennett, Derk Pereboom). However, this scheme is in fact somewhat misleading. It is true that Dennett is usually classified as an apriori materialist (or, more precisely an apriori materialist representationalist), but I believe that needs to be corrected. In order to understand why, I first analyze varieties of materialist representationalism in detail, in particular various construals of phenomenal character in terms of representation, or intentionality, which includes a discussion of the identity of its content (the issue of externalism). By contrast, Dennett rejects the concept of phenomenal character. Consciousness has no intrinsic, publicly inaccessible properties. On that ground, Dennett builds an empirical, fully functionalist theory of consciousness, which he also tries to integrate within a general Darwinian framework. From that point of view, one can contrast Dennettian and representationalist views on the issue of animal consciousness. In addition to his rejection of phenomenal character, Dennett also abstains from the regular metaphysical departure point of regular materialism. He does not so much ask how an enigmatic property of consciousness fits an antecedently characterized world, but rather how far we can investigate all aspects of the world, including consciousness, using the scientific method. He is thus a methodological naturalist, rather than a metaphysical materialist. While this approach removes obstacles to the science of consciousness, it does not solve what might be called “the hardest problem” – of intentionality, not phenomenal consciousness. The hardest problem consists in the fact that our intentional discourse involves conflicting commitments that prevent a coherent metaphysic of representational states. However, it does not follow that we should give up on this discourse as a theoretical means of reduction as well as a practical tool of explanation. But it might be that intentional discourse is a somewhat pseudo one. (shrink)

E. Dussel builds an ethics involved in the liberation of the victims of a world-system increasingly global. In this paper the contributions that this ethics of liberation does to the necessary project of an intercultural dialogue are studied. This dialogue must begin with a critic of modern reason, which is eurocentric and violent, and it has to be based on a «transmodern» rationality, whose starting point is the afirmation and the recognition of the reason of the Other (the excluded human (...) being). One of the greatest challenges of consciousness research is to understand the relationship between consciousness and its implementing substrate. Current research into the neural correlates of consciousness regards the biological brain as being this substrate, but largely fails to clarify the nature of the brain-consciousness connection. A popular approach within this research is to construe brain-consciousness correlations in causal terms: the neural correlates of consciousness are the causes of states of consciousness. After introducing the notion of the neural correlate of (...) consciousness, we argue (see Against Causal Accounts of NCCs) that this causal strategy is misguided. It implicitly involves an undesirable dualism of matter and mind and should thus be avoided. A non-causal account of the brain-mind correlations is to be preferred. We favor the theory of the identity of mind and brain, according to which states of phenomenal consciousness are identical with their neural correlates. Research into the neural correlates of consciousness and the theory of identity (in the philosophy of mind) are two major research paradigms that hitherto have had very little mutual contact. We aim to demonstrate that they can enrich each other. This is the task of the third part of the paper in which we show that the identity theory must work with a suitably defined concept of type. Surprisingly, neither philosophers nor neuroscientists have taken much care in defining this central concept; more often than not, the term is used only implicitly and vaguely. We attempt to open a debate on this subject and remedy this unhappy state of affairs, proposing a tentative hierarchical classification of phenomenal and neurophysiological types, spanning multiple levels of varying degrees of generality. The fourth part of the paper compares the theory of identity with other prominent conceptions of the mind-body connection. We conclude by stressing that scientists working on consciousness should engage more with metaphysical issues concerning the relation of brain processes and states of consciousness. Without this, the ultimate goals of consciousness research can hardly be fulfilled. (shrink)

By considering Davidson’s analysis of prepositions as defining individual events predicates, I argue against his semantics for action sentences and stress some logico-linguistic puzzles concerning both the interpretive pretension and the referential indifference of this proposal. Inspired by Evans as well as by Grice, I advance another interpretive semantics for those cases which does not take as assumption the individual character of events and argue for a constructivist approach to events in action discourse.

Donald Davidson and John Searle famously differ, among other things, on the issue of animal thoughts. Davidson seems to be a latter-day Cartesian, denying any propositional thought to subhuman animals, while Searle seems to follow Hume in claiming that if we have thoughts, then animals do, too. Davidson’s argument centers on the idea that language is necessary for thought, which Searle rejects. The paper argues two things. Firstly, Searle eventually argues that much of a more complex thought does depend on (...) language, which reduces a distance between himself and Davidson. Secondly, some of Davidson’s suggestions are promising – in particular the idea that we may lack a vocabulary to capture the contents of animal thoughts. Based on this insight, one might, pace Davidson, grant thoughts to animals. However, this does not mean, pace Searle, that it should be possible to construe even the simplest of such thoughts as propositional. Perhaps we need to move beyond Davidson and Searle by developing a theory of nonpropositional thought for animals. (shrink)

[Utilitarism, Nazism, and Euthanasia] The article is an answer to Prof. Munzarová who criticised my defence of physician-assisted suicide. The article points to shortcomings in the reply of prof. Munzarová which flow from the author’s underestimation of normative theory. Among these shortcomings are the ignoring of the arguments of her opponent; her calling into question the moral credit of the proponents of the competing theory (utilitarianism) rather than a critical analysis; unclear theoretical principles (a switching between paternalism and autonomy, the (...) presentation of the “principle of double-effect” as the standpoint of common sense); an unconvincing version of the “argument of the slippery slope” (ignoring the diametrical differences between the contemporary demand of some patients for assisted death and the Nazi programme of involuntary euthanasia). [Précis of What It’s Like, or What It’s About? The Place of Consciousness in the Material World] The paper provides a summary of my recent Czech-language book, WHAT IT'S LIKE, OR WHAT IT'S ABOUT? THE PLACE OF CONSCIOUSNESS IN THE MATERIAL WORLD (2017). As suggested by the subtitle, the topic of the book is philosophy of consciousness. In the contemporary literature, most participants have in mind the so-called phenomenal characters, and the main issue debated between dualists and materialists is whether (...) these characters are material properties. Even the Russellian monists, who otherwise present themselves as an alternative to both dualism and materialism, accept the concept of phenomenal character. I express doubts about this concept in chapter six of my book; accordingly, I allot most space in the paper to the material from this chapter. Despite the majority opinion, I believe that no agreement has in fact been reached concerning the content of this concept. Similarly to Daniel Dennett, I recommend trying to develop a philosophy of consciousness without the concept of phenomenal character. As is well known, Dennett – to some extent similarly to the aforementioned materialists – proposes a reduction of consciousness in terms of representation. However, I wound up rather more skeptical than Dennett, since following up on my previous book, THE METAPHYSICS OF ANTI-INDIVIDUALISMU (2008), I claim that a naturalistic theory of representation is incoherent. In this article, the concept of moralistic fallacy introduced by B. D. Davis is elaborated on in more detail. The main features of this fallacy are discussed, and its general form is presented. The moralistic fallacy might have some undesirable outcomes. Some of them might even be in direct conflict to the original moral position. If this occurs, it is possible to characterize it as a paradox of moralistic fallacy. The possibility of this paradox provides a further reason not to (...) prevent any scientific inquiries and not to depict any knowledge as dangerous. (shrink)

[Filip Tvrdý on Naturalizing Philosophy] The paper distinguishes several versions of contemporary naturalism: revisionary, constructive, and non-representational. Revisionary naturalism pleads substituting the traditional philosophical inquiry into the nature of things by a genetic inquiry into the origin of our – often faulty – beliefs about the nature of things. Constructive naturalism accepts the program of traditional philosophy, yet hoping that its questions could be answered by broadly scientific methods. Non-representational naturalism is an extension of metaethical expressivism, claiming that philosophical claims (...) should not be understood as descriptive in nature. These distinctions can help us classify the most self-consciously naturalistic project in the recent Czech philosophy, Filip Tvrdý’s TROUBLES OF INTROSPECTION (2015). Tvrdý is officially pursuing a genetic, revisionary project, which does not coincide with nonrepresentational naturalism. However, there are also traces of constructive naturalism in Tvrdý’s book. [From Euthanasia to Infanticide] The paper revisits the recent controversy over Dr. Mitlőhner’s defense of infanticide, published in this journal. In section 1, I point out the weaknesses of Mitlőhner’s paper. In sections 2 and 3 I turn to the most sophisticated defense of infanticide on offer today, that of Peter Singer’s. Section 2 sums up Singer’s description of the medical practice as already having abandoned the traditional ethic of equal value of all human lives, which motivates ethical revisionism. However, (...) an explicit justification of a revision is necessary. This is the job of Singer’s Replacement Argument, examined in section 3. I argue that this justification of infanticide in completely impersonal terms fails. In section 4, I reject it in favor of Ronald Dworkin’s distinction between experiential interests, possessed by infants, and critical interests that develop later. Hence, neonatal euthanasia can sometimes be justified in terms of a newborn‘s own interests (presumably, to relieve its suffering), not in impersonal terms. The only exception is those infants that lack any capacity for cognitive activity whatsoever, and who thus lack even experiential interests. It is an open question whether their “life” differs from death, and whether by killing them we perform infanticide. (shrink)

The research analyses the grounds for separation of employment relationship and independent contractors in civil relationship as it is established in legal provisions and court practice of the Republic of Lithuania. Firstly, criteria for separation of civil and labour legal relationship are analysed. Secondly, Lithuanian judicial practice is examined. Since employment contracts are closely related to undeclared work, thirdly, practise of recognizing of undeclared work is used as criteria for identification of employment relationship. The criteria of illegal and undeclared work (...) revealed in court practice are discussed. The changing nature of employment, atypical workers and independent contractors create many problems for separation of these relations. (shrink)

In this paper I asses Davidson’s analysis of action sentences stressing its quantificational structure and its views on prepositions and adverbial modification. Three arguments inspired by Grice’s ideas are deployed against it. First, I point to weird consequences of taking prepositions as defining predicates; second, I show some obstacles for Davidson’s view on adverbs; finally, I raise some doubts about his putative analysis of “negative actions”. From these, I hope that connections among actions, facts and events should be reconsidered in (...) action theory. (shrink)

This article presents an analysis of how a male convert to Islam incorporates events from his life history into a narrative structure in order to construct and maintain a Muslim identity. The study focuses on how the individual and in particular a person's life history becomes social and universal, and how the social and universal becomes particularized and individualized, in the narration of life. The results of the analysis showed that the valued endpoint determines the selection and ordering of different (...) episodes, and the causal connections that are made between them. Many episodes in this convert's life story is similar to other converts' narratives, for example, descriptions of absent significant others during childhood, an inclusion of a Christian phase in life, and the importance attributed to the Qur'an in the process of conversion. The incorporation of these episodes in one's life story and the way the narratives are structured are interpreted as influences from collective narratives. Moreover, the analysis revealed that the selected episodes have important social, individualizing and sedative functions in the flux of discourses in postmodern society. Thus, the individual's Muslim identity is an amalgamation of the particular and the universal and the importance of the narratives lies in the fact that they can integrate particular experiences into a universal structure that gives them a meaning. The paper is focused on the question whether a human person should be treated as a rational animal or an embodied spirit. The first definition of a human being goes back to Aristotle. In his conception human being is the highest animal, i.e. he is on the top of the hierarchy of material beings. The second definition shows human being on the lowest position in the realm of spirits. Here human being is the lowest and the least perfect among spiritual (...) beings, the only spirit who is submerged into material world. The paper presents and discusses the ideas of W. In this article there is analysed an independent criminal punishment – public works, which was determined by the Criminal Code and the Punishment Enforcement Code of the Republic of Lithuania as alternative punishment to freedom deprivation punishment. Without looking into the process of historical development, it is made an attempt to overview the tendency of public works’ spreading, to analyse the problems of public works’ realisation and how to deal with them. There is compared Lithuanian legal regulations with international documents, (...) which are related with alternative punishment as alternative to freedom deprivation punishment. There is also looked over public works’ legal regulations in foreign countries, an experience of public works implementation in Lithuania and abroad and, the most important, there had been given landmarks of public works institution improvement. The article is based upon the documents of the United Nations and the Council of Europe, legal regulations and practice of public works in foreign countries, opinion and studies of foreign scientists and the other authors, the data of statistics and questioning of the officers of correctional inspections. [On the Ethics of Euthanasia Again: A Reply to Critics] The article is a reply to three critics of a previous piece on the ethics of euthanasia in which I defended physician-assisted suicide. According to Ingrid Strobachová it is necessary to give a greater attention to the significance of pain, which, she claims, may benefit from a phenomenological description. According to Marta Vlasáková my argument is not valid because two principles on which it is founded – i.e. the conception of (...) life as of fundamental value and the autonomy of the patient – are not in mutual harmony. Jakub Jirsa criticises the very concept of assisted suicide and the moral legitimacy and need for the legalisation of assisted suicide. To Dr Strobachová I reply that phenomenological description is as acceptable a method as any other – as long, that is, as it is not only a verbal game, but constitutes a real source of knowledge. To Dr. Vlasáková I argue that a more charitable reading of my argument is possible. The arguments of Dr. Jirsa against assisted suicide are beset with various inconsistencies, including the fact that he himself allows that doctors should tolerate suicide by the refusal of food and drink. Such an act does not, however, differ in any relevant way from doctor-assisted suicide. (shrink)

Este artigo propõe relacionar as filosofias da história de Kant e de Hegel às bases do pensamento de Foucault, em História da loucura na idade clássica. Buscamos reconhecer, não indícios de uma história cosmopolita ou universal, mas em que medida o pensamento crítico e a filosofia como ciência das essências puras comparecem na inteligibilidade histórica de Foucault. A reunião de uma diversidade de experiências sob o conceito de desatino , fio condutor da obra, sugere uma proximidade com a tradição. Por (...) outro lado, a falta de um critério intrínseco, o qual justifique a referência de tal multiplicidade à alcunha da loucura, faz com que o fio condutor se restrinja a um aspecto negativo e que, positivamente, Foucault estabeleça para seu trabalho um primado empírico, na forma de uma constelação de imagens. O procedimento de História da loucura, que, junto ao interesse pela desrazão, inaugura o privilégio dado pelo filósofo francês à análise das descontinuidades nos leva a reconhecer a razão com base nos casos que solapam aos seus limites, às essências por ela própria discernidas, e com base nas práticas por ela promovidas e justificadas. This article proposes to relate Kant's and Hegel's philosophy of history to the basis of Foucault's History of Madness in the Classical Age. We are not attempting to recognize the presence of a cosmopolitan or universal history, but trying to understand how critical thinking and philosophy as the science of pure essences appear in Foucault's historical intelligibility. The challenge of bringing together a diversity of experiences under the concept of unreason , which is the common thread of the book, suggests an attachment to tradition. However, the absence of an intrinsic criterion justifying the reference of that multiplicity to madness motivates a negative aspect to that concept and, positively, makes Foucault establish for his work an empirical primacy, in the form of a constellation of images. The procedure of the History of Madness that, with its interest in unreason, inaugurates the privilege given by the French philosopher to the analysis of discontinuities, leads us to recognize reason based on cases that escape its limits and the essences discerned by itself. We find that the nature and origin of the proposed “dialogical cognitive representations” in the target article is not sufficiently clear. Our proposal is that (triadic) bodily mimesis and in particular mimetic schemas – prelinguistic representational, intersubjective structures, emerging through imitation but subsequently interiorized – can provide the necessary link between private sensory-motor experience and public language. In particular, we argue that shared intentionality requires triadic mimesis.

Článek se pokouší o koherentní interpretaci Quinových nečetných vyjádření na téma realismus. Autor konstatuje, že Quinovy názory vykazují různorodé tendence: Quine ve svých textech přechází od úvah, které bychom označili za idealistické , k pozici spíš realistické. Článek má dvě části. První je věnována Quinovu chápání positů a jeho tezím o naturalizaci filosofie a imanenci pravdy teorii. Druhá část pak obsahuje úvahu o Quinově známé tezi o nevymezitelnosti reference a jejích důsledcích pro otázku realismu. Autor dochází k závěru, že diskrepance (...) epistemologického a ontologického hlediska, přítomná v mnoha Quinových pracích, vede k permenantnímu rozštěpu dvou hledisek na realitu vnějšího světa, která se zdají být neslučitelná v jedné koherentní filosofické pozici.
